The Murray Review of Security of Payment Laws in Australia

On 21 December 2016, the Federal Government announced a national review of Security of Payment laws in the building and construction industry. 

The purpose of the review was to identify best practice, with a view to improving the consistency in security of payment legislation and the level of protection for subcontractors nationally.  

The review was undertaken by Mr John Murray AM and the final report of the review was released on 21 May 2018.  View the full report of the Murray Review here.  

The Murray Review contains 86 recommendations which cover a wide range of areas including issues outside of the current Security of Payment regime, such as Unfair Contract Terms, Project Bank Accounts and Statutory Trusts.  Importantly, the Murray Review supports the ‘East-Coast’ model, upon which existing South Australian legislation is based. The recommendations draw on the “best” parts of the various State Acts, and have adopted some of the changes previously proposed for the South Australian legislation.
