The Commissioner plays a regulatory role in relation to some matters affecting the motor vehicle insurance and repair industry. The Commissioner is responsible for administering the

  • Fair Trading (Motor Vehicle Industry Dispute Resolution Code) Regulations 2014; and
  • Fair Trading (Motor Vehicle Insurance and Repair Industry Code of Conduct) Regulations 2023

Fair Trading (Motor Vehicle Industry Dispute Resolution Code) Regulations 2014 - Motor Vehicle Industry Dispute Resolution Code

The Motor Vehicle Industry Dispute Resolution Code applies to participants in the motor vehicle industry, including motor vehicles businesses, businesses that have a connection to motor vehicle business, and businesses involving the supply of goods and services to persons engaged in motor vehicle business.

For the purposes of the Dispute Resolution Code, motor vehicle business includes the business of:

  • manufacturing
  • distributing
  • supplying
  • acquiring
  • repairing (excluding disputes between a motor vehicle insurer); or
  • restoring.

motor vehicles or motor vehicle parts or accessories.

This Code does not apply to disputes between a motor vehicle insurer and repairer that fall within the scope of the Motor Vehicle Insurance and Repair Industry Code of Conduct (refer below).

Any business or corporation operating as a motor vehicle insurer or repairer must comply with the National Motor Vehicle Insurance and Repair Industry Code of Conduct, regardless of whether they are a signatory.

The National Motor Vehicle Insurance and Repair Industry Code of Conduct compels participants in the motor vehicle insurance and repair industries to adhere to the industry expectations set out in the National Code and participate in the alternative dispute resolution processes prescribed in the Code.
